1. General Agreement

By accessing and using https://mellumeeyewear.com (“the Site”), you (“Buyer”, “Brand Client”) agree to comply with these Terms & Conditions, together with our Privacy Policy, Cookie Policy, Sample & Shipping Policy and Disclaimer.

Mellume Eyewear is a professional full-custom eyewear manufacturer focusing on full OEM & ODM development, custom frame molding, personalized logo, color matching, lens customization and exclusive packaging for global eyewear brands. All services and transactions are B2B wholesale only, not for end-user retail.

2. Private Catalog Access

Our password-protected exclusive catalog is only opened for verified brand buyers with formal customization demands. You shall not share login credentials, custom design drafts, mold data or confidential quotation files with any third-party eyewear competitors. We reserve the right to revoke catalog access for unauthorized information leakage.

3. Quotation & Custom Design Service

  1. All custom quotations are valid for 30 calendar days after issuance.
  2. Quoted cost covers mold opening, raw material, craft processing, logo printing and packaging as confirmed in your design brief. Prices may adjust due to global acetate, titanium, metal raw material price fluctuations without prior notice.
  3. All custom renderings, prototype drawings, mold blueprints and sample specs provided by our team are confidential intellectual property of both parties and cannot be reproduced or circulated without written consent.
  4. Free preliminary design sketch support is available for formal brand clients; deep structural modification after sample confirmation will generate extra design fees.

4. Custom MOQ Rules (Full Custom Orders)

  1. Brand exclusive full-custom frames (new mold development): Custom mold MOQ as stated in quotation, non-negotiable for new mold orders.
  2. Logo engraving, lens printing, frame color customization on existing molds: Separate customized MOQ requirements apply.
  3. Sample orders for custom development: Sample fee, mold trial cost and express shipping fee shall be fully borne by the buyer; samples are not free of charge unless a long-term bulk cooperation contract is signed.

5. Sample Development Policy

All sample-related rules are detailed in our independent Sample & Shipping Policy. By submitting custom sample requests, you fully accept all sample charges, prototype production lead time and shipping liability.

6. Payment Terms

  1. Acceptable payment methods: T/T Bank Wire Transfer, Western Union (only for small sample orders).
  2. Full custom bulk order payment flow: 40% deposit for mold opening & raw material procurement before production; the remaining 60% balance must be fully settled before shipment.
  3. All bank transfer handling charges shall be undertaken by the buyer.
  4. Credit payment is not available for new custom brand clients; credit terms can be negotiated only after stable long-term cooperation.

7. Custom Production & Lead Time

  1. Custom sample lead time: 10–18 working days after design confirmation and sample deposit received.
  2. Mass production lead time for full-custom frames: 25–50 working days, subject to order quantity, mold complexity, special electroplating, lens customization and packaging craft.
  3. Production delays caused by buyer’s delayed design confirmation, repeated revision of artwork, late deposit payment or special material shortage shall not be our liability.

8. Shipping, Customs & Logistics

  1. All shipping fees, import duties, local VAT and customs clearance costs in the buyer’s destination country are borne by the buyer, unless a free-shipping agreement is signed in writing.
  2. We support sea freight, air freight and international express (DHL/FedEx/UPS) for samples and bulk orders.
  3. All delivery dates are estimated timelines; force majeure factors including port congestion, customs inspection, logistics suspension and natural disasters will extend delivery cycles without compensation.

9. Full OEM & ODM Customization Specification

  1. The buyer shall provide finalized logo vector files, color standard cards, size parameters and packaging artwork before mold opening and mass production. Any design revision after mold trial or mass production launch will incur extra rework and material costs.
  2. All exclusive molds, custom frame shapes and personalized packaging developed exclusively for your brand will not be reused or resold to other brand clients without your written NDA authorization.
  3. We may display finished custom eyewear products in our factory portfolio and website for brand showcase only, unless you sign a non-disclosure agreement to restrict display.

10. Inspection & Quality Standard

  1. Pre-shipment full inspection is available before balance payment settlement. The buyer can arrange third-party eyewear inspection at their own expense.
  2. Minor craft differences within the global eyewear industry standard tolerance range do not qualify for full refunds or replacements.
  3. Damages caused by improper storage, buyer’s self-modification of frames/lenses or incorrect assembly are not covered by after-sales service.

11. Order Cancellation & Refund Rules

  1. Custom mold orders can only be fully canceled before mold manufacturing starts, with full deposit refund.
  2. Once mold opening, sample production or mass production commences, all deposits are non-refundable to cover mold development, raw material and labor costs.
  3. Quality complaint refund applications must be submitted with clear photos and video evidence within 7 working days after goods delivery.

12. Intellectual Property Statement

  1. All Mellume Eyewear original frame structures, craft technology, website pictures and design descriptions are protected by copyright. Unauthorized copying, imitation and commercial reproduction are prohibited.
  2. The buyer’s own brand trademarks, logos and exclusive custom designs remain the buyer’s intellectual property. We will never use your brand’s proprietary designs for other cooperative clients.

13. Color & Product Disclaimer

Due to digital screen color deviation, website photos cannot achieve 100% color consistency with physical custom frames. All factory qualification certificates including FDA Drop Ball Test, BSCI, TUV and ISO are available for brand verification. See our independent Disclaimer page for full details.

14. Force Majeure

We are not liable for production or delivery delays caused by uncontrollable events: natural disasters, factory power suspension, international trade policy adjustments, epidemic control and global logistics breakdown.

15. Policy Update Right

We reserve the right to revise these Terms & Conditions to match updated production craft, international trade rules and business adjustments. All revisions will be published on this page with an updated date. Your continued use of this website confirms acceptance of revised clauses.
